MyChart Terms of Use

Overview
MyChart is operated and provided to you by Seattle Children's Hospital (Seattle Children's). You can use MyChart to:
(i) view certain information stored on the Electronic Health Record (EHR) maintained by Seattle Children’s;
(ii) view and act on appointments;
(iii) view account balances and billing information;
(iv) pay your bill, and
(v) communicate securely with Seattle Children’s health care providers.
Acceptance of Terms of Use
By accessing or using MyChart at Seattle Children’s, you accept and agree to be
bound and to abide by these Terms of Use (Terms), Seattle Children’s Privacy
Policy, and any guidelines, rules, and policies applicable to such
functionality, features or services that may be posted from time to time
(Policies). Seattle Children’s Privacy Policy and all such Policies are hereby
incorporated by reference into these Terms. If you do not want to agree to
these Terms (including our Privacy Policy or Policies), you must not access or
use MyChart.
Terminology
The following terminology applies to these Terms and Conditions. "You" and "your" refers to you, the person accessing MyChart at Seattle Children’s and accepting these Terms. “Seattle Children’s” “we” “us” and “our” refers to Seattle Children’s Hospital. "Patient" or "patients" refer to patients, minor patients, parents, patient's guardians or the patient's other legally authorized representative.
Accessing
MyChart
Seattle Children's reserves the right to terminate or change MyChart, and any services, functionality, features or materials Seattle Children’s provides via MyChart, at any time in Seattle Children’s sole discretion without notice to you. In addition, Seattle Children's may terminate or suspend your access to MyChart and may delete your account at any time without providing notice to you. Seattle Children’s will not be liable if for any reason all or any part of MyChart is unavailable at any time or for any period. From time to time, we may restrict access to some parts of MyChart, or the entire MyChart, to users, including registered users.
Use of MyChart
By establishing a MyChart connection and accessing the account of a patient through MyChart at Seattle Children’s, you are attesting to and warranting that you maintain parental rights or legal guardianship for a patient.
Due to state and federal laws, certain categories of medical information for children may not be viewed without consent from the child. Consistent with these laws, proxy access will display limited information for patients when they become 13 years of age. Complete (for patients less than 13 years of age) and partial (for patients between 13 and 17 years of age) proxy access will be granted only to individuals with parental rights or legal guardianship for a patient.
You must not permit any other person to access MyChart using
your username and password. The security of your password and the use of your
account is your responsibility. If you learn or suspect that your username or
password has been wrongfully used or disclosed, you should promptly notify
Seattle Children's by telephone at 206-987-4444 (Monday through Friday, 8 a.m. to 4
p.m.) and reset your password immediately. MyChart is an information
management tool only; these Terms permit you to use MyChart for your personal
and non-commercial use only.
MyChart Information
The information available for you to view through MyChart is not a
comprehensive view of all the information in the EHR. Your communications with
Seattle Children’s health care providers via MyChart, and the content of your
messages, will be included in the EHR.
You agree that you will not provide, upload, email, post and/or transmit to or through MyChart any content that:
(i) violates these Terms or is unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, offensive, harassing, hateful, embarrassing, pornographic, profane, sexually explicit, or indecent;
(ii) constitutes or encourages conduct that would constitute a criminal offense, potentially give rise to civil liability (including claims of defamation and/or libel), or otherwise violates local, state, or federal law;
(iii) violates, plagiarizes, or infringes the rights of third parties including, without limitation, copyright, trademark, patent, rights of privacy or publicity, trade secrets, or any other proprietary right;
(iv)contains or introduces a virus, worm, Trojan horse, logic bomb or other material which is malicious or technologically harmful;
(v) attempts to gain authorized access to, interfere with, damage or disrupt any parts of MyChart or any server, computer or database connect to MyChart;
(vi)contains any information, software, or other material of a commercial nature;
(vii) contains solicitations, promotions or advertisements of any kind, or
(ix) Otherwise attempts to interfere with the proper working of MyChart.
Privacy
You agree to the terms and conditions of the MyChart
Privacy Policy
, which are incorporated into and made part of these Terms. Our treatment of your individually identifiable health information generally, whether or not submitted or accessed by you via MyChart, is governed by our
Notice of Privacy Practices.
External Links
In order to provide you with greater value, Seattle Children's may provide you
with links to various third-party Web sites. If MyChart contains links to
other sites and resources provided by third parties, these links are provided
for your convenience only. Seattle Children’s has no control or over the
content of these linked sites and accepts no responsibility for them or for any
loss or damage that may arise from your use of them. If you decide to access
any of the third-party websites linked to MyChart, you do so entirely at your
own risk, and your use of these third-party websites is governed by any terms
of use posted on such third-party website and not by these Terms. The
provision of links to third party Web sites or the mention of specific
products, processes, or services on MyChart does not constitute or imply a
recommendation or endorsement by us.
No Warranties
YOU ACKNOWLEDGE AND AGREE THAT SEATTLE CHILDREN'S DOES NOT REPRESENT MYCHART AS
HAVING THE ABILITY TO DIAGNOSE DISEASE, PRESCRIBE TREATMENT, OR PERFORM ANY
OTHER TASKS THAT CONSTITUTE THE PRACTICE OF MEDICINE OR OF OTHER PROFESSIONAL
OR ACADEMIC DISCIPLINES, AND THE USE OF MyChart IS NOT INTENDED TO BE A
SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS OR TREATMENT. SEATTLE
CHILDREN'S MAKES NO REPRESENTATIONS OF ANY KIND ABOUT THE SUITABILITY,
RELIABILITY, AVAILABILITY, TIMELINESS, COMPLETENESS, SECURITY, QUALITY OR ACCURACY
OF MyChart. WITHOUT LIMITING THE FOREGOING, SEATTLE CHILDREN’S DOES NOT
REPRESENT OR WARRANT THAT MYCHART, ITS CONTENT OR ANY SERVICES OR ITEMS
OBTAINED THROUGH MyChart WILL BE ACCURATE, RELIABLE, ERROR-FREE OR
UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTS, THAT MYCHART OR THE SERVER THAT
ITS MAKES IT AVAILABLE ARE FREE OR VIRUSES OR OTHER HARMFUL COMPONTENTS OR THAT
MyChart OR ANY SERVICES OR ITEMS OBTAINED THROUGH IT WILL OTHERWISE MEET YOUR
NEEDS OR EXPECTATIONS. SEATTLE CHILDREN’S WILL NOT BE LIABLE FOR ANY LOSS OR
DAMAGE CAUSED BY ANY VIRUSES OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY
INFECT YOUR COMPUTER REQUIREMENT OR PGORAMS DUE TO YOUR USE OF MyChart OR ANY
SERVICES OR ITEMS OBTAINED THROUGH MYCHART OR TO YOUR DOWNLOADING OF ANY
MATERIAL POSTED ON IT, OR ON ANY THIRD-PARTY WEBSITE LINKED TO IT.
MYCHART, ITS CONTENTS AND ANY SERVICES OR ITEMS OBTAINED THROUGH
MYCHART ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER
EXPRESS OR IMPLIED. SEATTLE CHILDREN'S HEREBY DISCLAIMS ALL WARRANTIES AND
CONDITIONS OF ANY KIND WITH REGARD TO MYCHART, WHETHER EXPRESS OR IMPLUED,
STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES AND
CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND
NON-INFRINGEMENT. SEATTLE CHILDREN'S WILL NOT BE RESPONSIBLE FOR ANY ERRORS OR
OMISSIONS IN MYCHART. YOU ASSUME ALL RISK FOR YOUR SELECTION AND USE OF MYCHART.
Limitation of Liability
IN NO EVENT SHALL SEATTLE CHILDREN'S AFFILIATES, OFFICERS, TRUSTEES, EMPLOYEES,
PROVIDERS, VENDORS, LICENSORS OR AGENTS, OR ANY OF THEIR SUCCESSORS OR ASSIGNS BE
LIABLE FOR DAMAGES OR ANY KIND, INCLUDING BUT NOT LIMITED TO, ANY DIRECT,
INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY
WAY CONNECTED WITH YOUR USE OF MYCHART OR WITH THE DELAY OR INABILITY TO USE MYCHART,
OR WITH HYPERTEXT OR GRAPHIC LINKS TO THIRD PARTIES, OR FOR ANY BREACH OF
SECURITY ASSOCIATED WITH THE TRANSMISSION OF YOUR CONTENT THROUGH MYCHART, OR
FOR ANY INFORMATION OR MATERIALS OBTAINED THROUGH MYCHART, OR OTHERWISE ARISING
OUT OF YOUR USE OR ACCESS TO MYCHART, WHETHER BASED ON CONTRACT, TORT, STRICT
LIABILITY OR OTHERWISE, EVEN IF SEATTLE CHILDREN'S HAS BEEN ADVISED OF THE
POSSIBILITY OF DAMAGES AND EVEN IF SUCH DAMAGES RESULT FROM SEATTLE
CHILDREN'S'S NEGLIGENCE OR GROSS NEGLIGENCE. YOU SPECIFICALLY AGREE THAT
NEITHER SEATTLE CHILDREN'S NOR ITS AFFILIATES, OFFICERS, TRUSTEES, EMPLOYEES,
PROVIDERS, VENDORS, LICENSORS OR AGENTS, OR ANY OF THEIR SUCCESSORS OR ASSIGNS,
SHALL HAVE ANY LIABILITY TO YOU FOR ANY REASON OR UNDER ANY THEORY WHATSOEVER,
BASED UPON THE INFORMATION PROVIDED ON OR THROUGH MYCHART AND/OR YOUR ACCESS TO
AND/OR USE OF THE SITE. THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH
CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
Exclusive Remedy
Your sole remedy against Seattle Children's in the event of a dispute arising out of these Terms and/or your use of or access to MyChart, is to cease your use of MyChart.
Indemnification
You agree to indemnify, defend, and hold Seattle Children's (its affiliates, officers,
directors, trustees, employees, contractors, agents, licensors, service
providers and suppliers) harmless from and against all claims, actions or
demands, liabilities, losses and settlements, damages, and expenses, including,
without limitation, reasonable legal and accounting fees, arising out of or
related to, or alleged to arise out of or relate to, your violation of these
Terms or your use of or access to MyChart.
No Unlawful or Prohibited Use
You may not use MyChart for any purpose that is unlawful or prohibited by these
Terms. You may not use MyChart in any manner which could damage, disable,
overburden, or impair MyChart, or interfere with any other party's use and
enjoyment of MyChart. You may not obtain or attempt to obtain any materials or
information through any means not intentionally made available or provided to
you through MyChart.

General
All matters related to MyChart, these Terms (including our
Privacy Policy
and any Policies, as defined above), and any dispute or claim
arising therefrom or related thereto shall be governed by and construed in
accordance with the laws of the State of Washington, as such laws apply to
contracts formed within Washington by Washington residents, without regard to
its conflict of laws provisions. You consent to the exclusive jurisdiction and
venue of courts in King County, Washington, for all legal suits, actions or
proceedings arising out of or relating to these Terms or your use of or access
to MyChart. At Seattle Children’s sole discretion, it may require you to submit
any disputes arising from these Terms or your use of MyChart, including
disputes arising from or concerning their interpretation, violation,
invalidity, non-performance or termination, to final and binding arbitration
under the Rules of Arbitration of the American Arbitration Association applying
Washington law. Any cause of action or claim you may have with respect to
these Terms or your use of or access to MyChart must be commenced within one
(1) year after the claim or cause of action arises. If we fail to enforce any
of these Terms, such failure will not be considered a waiver, or to be a
continuing waiver, of such Term(s) or any other term or condition.
If any part of these Terms is determined to be invalid or unenforceable then
the invalid or unenforceable provision shall be superseded by a valid,
enforceable provision that most closely matches the intent of the original
provision and the remainder of these Terms shall continue in effect.
These Terms, our Privacy Policy and any Policies constitute the sole and entire
agreement between you and Seattle Children’s with respect to your use of
MyChart and supersede all prior and contemporaneous understandings, agreements,
representations and warranties, both written and oral, with respect to your use
of MyChart. These Terms do not confer any rights on any third party. Seattle
Children's may assign its rights and duties to any party at any time without
notice to you.
Changes
Seattle Children's reserves the right at any time to, among other actions,
change these Terms, modify any part of MyChart, including eliminating or
discontinuing functionality, content and/or features. Any changes Seattle
Children's makes to these Terms will be effective immediately upon Seattle
Children's posting updated Terms and will apply to all access to and use of
MyChart thereafter. Your continued use of MyChart following the posting of any
revised Terms means that you accept and agree to any and all such changes. You
are expected to check this page periodically so you are aware of any changes,
as they are binding on you.
Copyright and Trademark Notices
MyChart and its entire contents, features and functionality are owned by
Seattle Children’s, its licensors or other providers of such material and are
protected by United States and international copyright, trademark, patent and
other intellectual property or proprietary rights laws. These Terms permit you
to use MyChart and the information contained therein only for personal,
non-commercial use. You must not reproduce, distribute, publicly display, republish,
download, store or transmit any of the material on MyChart, except that you may
print or electronically store a single copy of content from MyChart for your own
exclusive, personal, non-commercial use and not for further reproduction,
publication or distribution. The compilation of content on MyChart belong
exclusively to Seattle Children’s.
Seattle Children’s and MyChart’s name, logo, and all related
names, logos, product and service names, designs and slogans are trademarks of Seattle Children’s or its affiliates or licensors.
Any rights not expressly granted herein are reserved.
